Constitutional Court dismisses SAHRC appeal over directive powers involving Mpumalanga water access dispute [SOUND]

# The Constitutional Court has dismissed an appeal by the South African Human Rights Commission arising from a Mpumalanga water dispute involving Agro Data, FC Boshoff and local community members. Judge Steven Majiedt confirmed that SAHRC directives are not legally binding and cannot compel compliance. Majiedt said the Commission’s role is to facilitate redress, not impose remedies. He ruled the SAHRC must approach the court where parties refuse compliance, not enforceable obligations:
